Terms of Service

These Terms govern your use of CallCatch ("CallCatch," "we," "us"). By creating an account or using the service, you agree to these Terms. If you are using CallCatch on behalf of a business, you represent that you are authorized to bind that business.
The service
CallCatch detects your missed or forwarded calls, sends an automated SMS follow-up to the caller, qualifies the job over SMS, and delivers a lead summary to you by SMS, email, and dashboard. Phone numbers and messaging are provisioned through our telephony provider.
SMS messaging program
Program: CallCatch missed-call follow-up. When you call a business that uses CallCatch and the call goes unanswered, the business sends an automated SMS to follow up on your inquiry and qualify the job. Message frequency varies (typically a brief follow-up exchange per missed call). Message and data rates may apply. For help, reply HELP or email support@try-callcatch.com. To stop messages at any time, reply STOP. We do not share mobile information with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.
Subscription, free trial, and billing
CallCatch is a subscription billed at $99 per month through Stripe. New subscriptions include a 14-day free trial. If you do not cancel before the trial ends, your payment method is automatically charged $99/month, and the subscription renews automatically each month until you cancel. You can cancel at any time from the billing page (Manage billing → Cancel). Cancelling before the trial ends means you are not charged; cancelling later stops future renewals, and access continues through the end of the current paid period. Fees already charged are non-refundable except where required by law.
Your responsibilities and SMS compliance
You are responsible for using CallCatch lawfully, including compliance with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and carrier requirements. You must have a lawful basis to message the callers whose numbers you process, disclose on your own channels that callers may receive SMS, and honor opt-out requests. CallCatch suppresses messages to anyone who replies STOP and provides HELP responses, but you remain responsible for the consent and content practices of your account.
Your representations and indemnity
You represent and warrant that you have a lawful basis and any required consent to send, or to have CallCatch send on your behalf, SMS messages to the individuals whose phone numbers you process. CallCatch acts solely as a service provider at your direction. You agree to defend, indemnify, and hold harmless CallCatch and its providers from any claim, penalty, fine, or liability (including under the TCPA, CAN-SPAM, or state-law analogs) arising from your messaging, consent, content, or data practices.
Acceptable use
You may not use CallCatch to send marketing or promotional blasts, unlawful content, or messages to recipients who have not contacted your business. CallCatch is for transactional follow-up to your own inbound callers only.
Disclaimers and liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. We do not guarantee that every caller will reply, that messages will be delivered without carrier delay, or that any particular lead will result. To the maximum extent permitted by law, CallCatch is not liable for indirect or consequential damages, and our total liability is limited to the fees you paid in the three months before the claim.
Changes and termination
We may update these Terms; material changes will be posted here with a new date. We may suspend or terminate accounts that violate these Terms. You may stop using the service at any time by cancelling your subscription.
